Trademark FAQs - related questions & answers
Question: How do I find out whether the mark I’ve chosen is already registered?
Answer: It is strongly suggested that you search federally registered trademarks and service marks, since a federally registered mark generally preempts a state issued registration.
Question: Who must be licensed?
Answer:
Anyone or any business/organization that wants to use another person’s trademark on their own product must have a license before offering the product/goods for sale.
Question: What is the drawing?
Answer:
The "drawing" is a page which depicts the mark applicant seeks to register. In an application based on actual use, Section 1(a), 15 U.S.C. §1051(a), the drawing must show the mark as it is actually used.
